General Terms and Conditions
This contract regulates the contractual relationship of sale between the provider and the user at the moment the latter accepts the purchase during the contracting process.
The contractual relationship of sale entails the delivery of a specific product, in exchange for a price determined and publicly displayed on the website.
These General Terms and Conditions bind both parties and form an integral and inseparable part of the contract of sale. This contract becomes effective at the time the order is placed at the request of the user, through the contracting mechanisms that will be specified later, all in accordance with the provisions of Article 1,255 of the Civil Code, which establishes the principle of autonomy of will and agreements between the contracting parties.
The conditions stipulated below will enter into force between the parties only when the seller has confirmed the order and sent all the conditions set forth to the buyer.

COVERAGE OF OUR PRODUCTS
The use of this website, as well as any transaction made through it, is considered to have taken place in Spain and, therefore, is subject to current Spanish laws and regulations, without prejudice to any applicable legislation depending on the consumer's status.
The purpose of these General Conditions is to establish the regulatory framework for the conclusion of the Contract. These conditions will be supplemented, where appropriate, by the corresponding Specific Conditions.
As a Consumer, the Contract entered into is governed by Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter referred to as the TRLGDCU).
CONTRACTING PROCEDURE. - How can I purchase online?
In order to access the products offered by PROCOMOBEL and make a purchase, you must freely and voluntarily provide the personal data requested.
Please note that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:
1. Click on the product you wish to select and press the "add to cart" button.
2. If you wish to continue shopping, press the "continue shopping" button.
3. Once you have selected the products you wish to purchase, as well as the quantity, click "Checkout."
4. Next, you must provide your personal information. For this purpose, you can log in or create an account to complete your order, or, if you prefer, make your purchase without registering as a guest.
5. Next, you must provide a delivery address and your chosen shipping method.
6. On the same screen, on the right, you will see a cart summary with the selected products, price, taxes, and shipping costs (if applicable).
7. Finally, you must select your preferred payment method and confirm your purchase using the "ORDER WITH PAYMENT OBLIGATION" button.

The user has access to technical resources provided by PROCOMOBEL during the contracting process to identify and correct possible errors in data entry. If any errors are identified in the data entry process, the user may follow these steps:
• Customer Area: Access the customer area using the credentials provided during the registration process. Identify the corresponding transaction and select the data correction option. Modify the incorrect data and confirm the changes.
• Customer Service: If direct assistance is preferred, the user may contact our Customer Service through the enabled communication channels, indicating the incorrect information and providing the correct information for immediate update.
It is important to note that once the shipping company takes charge of the product, any requests for changes related to the delivery must be made directly to the shipping company, using the tracking number provided. Data correction in this context will be subject to the shipping company's discretion.
Please also note that, for security reasons, if you choose PayPal as your payment method, once your order has been placed, no changes to the shipping address will be permitted.

The product descriptions offered on our website are based on the product catalog of PROCOMOBEL, an online store specializing in furniture.
The products featured on our website are carefully selected from our collection. We have taken special care to accurately display the colors and features of our products. However, due to the variability in the quality or resolution of monitors or devices used by users, it is important that you carefully review the product description on the purchase form, as it is not subject to such contingencies.
In addition, to provide more complete information, we will also indicate the product's stock availability. In the event of an error whereby a product is shown as available but is no longer available after purchase, PROCOMOBEL will inform the user of this situation in accordance with the provisions of our "RETURNS POLICY – Out of Stock" section.
PRICE INFORMATION

In the case of sales with a gift or incentive, this may be delivered within the period determined by the sale, without exceeding the period established in each Autonomous Community, which in any case will not exceed three months from the expiration date of the promotion.

INFORMATION ON PAYMENT METHODS
Payment of the price through the website is made at the time of purchase, and PROCOMOBEL will send you a confirmation email informing you of the expected date for receipt of the product.
PROCOMOBEL declares that it does not have access to or store sensitive data related to the payment method used by the User, except for that strictly necessary for processing the payment. Only the corresponding financial institution processing the payment has access to this data for the management of payments and collections. Once the purchase process is completed, an electronic document is generated formalizing the contract, which the user can print.
PROCOMOBEL reserves the right to cancel orders in accordance with these terms and conditions. You can find the reasons for cancellation in the specific section that regulates these conditions.
What payment method can I use to make my online purchase?
Payment for the products offered by the entity can be made by:
1. Credit or debit card. Visa, MasterCard, Maestro, Discover Card, Diners Club, and UnionPay. If your payment method is a bank card, by clicking "Order with payment obligation" you are confirming that the credit card is yours. If you receive a notification that your card has been declined and you have verified that the card has not expired and that the information number associated with your card is correct, you should first contact your bank to determine the reason for the decline or lack of authorization.
2. PayPal. If you choose PayPal as your payment method, once the order has been placed, no changes to the shipping address are permitted.
3. Bizum
4. Bank transfer.
5. In-store (with no increase on the final price). With this method, payment will be made at the store selected for pickup. Orders paid in-store will be held for 3 business days pending payment/pickup, starting the day after the order is placed.

7. Financing. Through the financial institution "PAYPAL," you can defer your payments in 3-month installments or up to 12 installments with "SABADELL CONSUMER" or "CETELEM," with payment beginning the same month. If you exercise your right of withdrawal within 14 days of the product purchased from PROCOMOBEL, this right will also result in the cancellation of the credit without any penalty to you (Article 77 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws). Once the order is placed, the company will immediately confirm your purchase. These General Terms and Conditions will remain on this website and must be accepted by you before making the payment.
How can I pay by bank transfer?
If you have chosen bank transfer as your payment method, you have a maximum of 5 business days to complete the payment. The order will begin processing once the company has received confirmation of the payment.
If we have not received the payment within 5 business days, we will cancel the order.
What information should I use to make the bank transfer?

Is it safe to enter my credit card information on the website?
As you can see in our security policy, our payment methods are secure. Our online store has an SSL certificate that protects the banking information transferred during the purchase process using encryption methods. Confidential credit or debit card payment information is transmitted directly and securely to the financial institution.
When making the payment through the gateway, the system will automatically verify that the credit card is activated for Secure E-Commerce. You will then be connected to the card issuing bank, which will request authentication and authorization of the transaction.
My card has been declined. What can I do?
If you receive a notification that your card has been declined, you should first contact your bank to find out why. However, this can occur for several reasons:
1. The most common reasons for payment declines are related to payment security policies. When making a payment through the secure payment gateway, the system will automatically verify that the card is activated for Secure E-Commerce. It will then connect to the issuing financial institution, which will ask the buyer to authorize the transaction using a personal authentication code. The transaction will only be completed if the credit card issuing bank confirms the authentication code, at which point the card will be charged. Otherwise, the transaction will be declined.
2. The card may be expired. Check that your card has not exceeded its expiration date.
3. Credit limits or fund holds. The card's limit for making purchases may have been reached.
4. Data entered incorrectly. Check that you have filled out all the required fields with the correct information.
In any case, your bank is the only one that can provide you with the exact reason why a payment has been rejected.
5. My card has been used fraudulently. What should I do?
You must notify PROCOMOBEL via email or phone of any improper or fraudulent charges to the card used for online purchases as soon as possible, so that PROCOMOBEL can take the appropriate action.
Invoice Information
The company generates electronic invoices provided you authorize us in advance at the end of the purchase. If you have not selected your consent to receive the invoice electronically, we will provide your paper invoice along with your order shipment, as this will be the default format.
If you have not checked the box authorizing the issuance of the invoice in electronic format, but are interested in receiving it in that format, you can request it later through your user area if you are a subscriber to any of our products or services, or by writing to the email address provided in these terms and conditions.
The invoice will be issued in the name of the individual or legal entity placing the order; therefore, the User must ensure that the buyer's information is correct and complete.
No subsequent changes will be possible.
PROCOMOBEL advises that, to preserve data confidentiality, duplicate invoices will only be issued to the contract holder. No duplicate invoices will be issued to third parties.
SHIPPING POLICY
• Delivery Time
PROCOMOBEL collaborates with two specialized transport companies for its deliveries:
Deliveries by Tamdis (orders over 20 kg or requiring assembly):
Tamdis delivers the order directly to the address specified by the customer. The furniture will be placed inside the home as specified by the customer. However, unpacking and assembly are not included in this service, unless the delivery with additional assembly fee has been contracted.
Assembly is not included for products that require electrical or plumbing connections, or ceiling or wall installation.
The recipient must sign the Tamdis delivery note as "CONFORM" or "NON-CONFORM." In the event of non-conformity, detailed comments will be requested.
It is the customer's responsibility to ensure that delivery can be made through standard access points (doors, stairs, elevator).
A confirmation notice and a tracking link will be provided once the order arrives at the carrier's agency.
Tamdis will coordinate delivery by phone, with a two-hour window, Monday through Friday, from 8:00 a.m. to 8:00 p.m.
CTT deliveries (orders up to 20 kg or orders that do not require assembly):
CTT delivers the order directly to the customer's home.
A confirmation email with the package number and a tracking link will be sent once the order is in the hands of the carrier.
In case of absence, a notice will be left to reschedule delivery or pick up the package at a collection point within 10 business days.
Deliveries are typically made during business hours from 8:00 a.m. to 8:00 p.m., but preferred times can be requested.
The shipping price varies by area and order amount and will be displayed before checkout.
Depending on the order volume and destination location, the delivery time may be extended, although the customer will be informed during checkout.
In the event of force majeure or circumstances beyond PROCOMOBEL's control that prevent delivery, the user will be notified as soon as possible.
• Delivery Location
PROCOMOBEL undertakes to deliver the product in perfect condition to the address indicated by you, which must, in all cases, be within Spain. In order to optimize the delivery process, the address you provide must be one where delivery can be made during normal business hours.
Therefore, PROCOMOBEL assumes no liability if delivery of the product is not made due to false, inaccurate, or incomplete information provided by the user, or if delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient, in these cases.
In addition, we offer the option of direct pickup at our physical store located in Madrid, at no additional cost. This service allows you to have your products within 24 hours of placing your order online.
This option provides flexibility and convenience, allowing you to choose the option that best suits your needs.
• Transfer of Risk and Ownership
Delivery is deemed to have taken place from the moment the product has been made available to the User or a third party indicated by them (other than the carrier) at the indicated delivery location. The risk of the products (including, but not limited to, loss, damage, or theft) will be transferred to the User from the moment the product(s) have been made available to them. However, if the consumer or user orders the transport of the goods or the chosen carrier is not among those proposed by the entrepreneur, the risk will be transferred to the consumer or user upon delivery of the goods to the carrier, without prejudice to their rights against the carrier.
• Delivery Problems
If you notice dents, scratches, bumps, watermarks, missing package numbers, among other things, it is very important that, depending on the damage, you reject the order and inform the delivery person. If the damage is only superficial, request a note on the delivery note from the delivery person, which cannot be denied. This will prove that the shipment arrived in apparent poor condition. Take photographs of the condition of the order upon delivery.
Then contact PROCOMOBEL Customer Service.
If the damage is not noticeable when the box is closed, but the contents are damaged when you open the package, please contact us within 24 hours and send us noticeable photographs of the damage.
Please note that sometimes shipping companies have their own conditions and exclude the loading of furniture into homes without an elevator or in conditions that make delivery excessively difficult. If you live in an old address or one with special delivery requirements, please inform us in advance so we can inform the shipping company and find the best solution.
In the case of deliveries with Tamdis (orders requiring assembly or weighing more than 20 kg), the recipient will be asked to sign the Tamdis delivery note in the corresponding box: CONFORM or NON-CONFORM. In the latter case, the Recipient will be asked to provide as much detail as possible in the Observations section.
LEGAL GUARANTEE
The User may exercise the THREE-YEAR legal guarantee for a product/service in accordance with current regulations on consumer product warranties, Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users, and other complementary laws. Additionally, you will be required to maintain the availability of repair parts and adequate technical service for 10 years from the date the product ceases to be manufactured.
To exercise the warranty, it is recommended that you retain proof of purchase.
RETURN POLICY
• Right of Withdrawal
Products that do not fall within the exceptions set forth in Article 103
To return a product, as an individual, you have a maximum period of fourteen (14) calendar days from receipt of the product.
The return shipping costs will be your responsibility.
Examples of when the withdrawal period does not apply:
• Products made according to the buyer's specifications cannot be returned.
• Products in the Special Edition collection have been customized by our team of decorators; they are unique pieces designed and manufactured upon request. Due to their personalized nature, they cannot be returned by the customer.
IMPORTANT:
Products made to order and personalized (all those for which different options can be selected within the website) are returnable, but you will be charged 50% of the total order. This is due to the fact that the product is handcrafted specifically for the customer. These products are made to order and are completely personalized, and it is impossible to provide after-sales service. Shipping costs for both the outbound and return shipments will also be billed to the customer.
The right of withdrawal does not apply to products made according to the customer's specifications or clearly personalized.
In the case of personalized or custom-made products, according to Law 3/2014, of March 27 (article 103), which modifies the LOCM (Organic Law on Customs and Customs), article 45, the Consumer's Right of Withdrawal and Return does not apply.
You have 24-48 hours to make any modifications or cancellations to products made to order at the customer's request. After this time, changes or cancellations of the order cannot be made. If you wish to cancel or modify the order, you will be charged 50% of the total order amount. This is because the products are already custom-made, and the manufacturer does not accept changes or returns. After-sales service for customized products is impossible.
How should you proceed when returning a product?
1. The products must be returned in the same condition in which you received them, along with any related accessories. It is advisable to include a photograph of the condition of the product and its packaging.
2. Shipping costs associated with the return of the product will be borne by the customer, unless the return is the result of an error on our part or the product has manufacturing defects.
3. Under no circumstances will we accept returns sent freight collect.
4. PROCOMOBEL SL reserves the right to refuse products that belong to a single order and are returned and delivered at different times.
Once we verify that the products you return meet all the specifications of the Return Policy, we will send you an email informing you that the return has been accepted.

• Returns of defective products
A full refund will only be issued using the same payment method used by the customer at the time of delivery if a defect is detected upon receipt, a delivery error is detected, or if the product arrives unsealed. In addition to the aforementioned rights, you will be entitled to a refund of the price of defective or incorrectly delivered products, as well as the corresponding shipping costs.
In these cases, you must:
• Contact us immediately, within 24 hours of delivery, via email at info@procomobel.com, detailing the error or defect along with your personal information.
• To return a product due to a defect, poor condition, expiration date, etc., it is essential that, upon detecting a discrepancy with the product, you take one or more photos that clearly show the problem.
• Returns of products in poor condition or incorrect condition must follow the procedure established in the previous section and be sent to the following address: Ctra/ Alto Del Moncayo S/n (03140), Guardamar Del Segura, Alicante.
• Once we have been informed of the detected defect, we will thoroughly examine the returned product and notify you by email within a reasonable timeframe whether a refund or replacement is appropriate, if applicable. The refund or replacement of the item will be made as soon as possible and, in any case, within 30 days of the date we send you an email confirming that the refund or replacement of the non-compliant item is appropriate.
• Provided you follow the established procedure and meet the requirements mentioned in these General Conditions, PROCOMOBEL will refund the price paid for returned products that are defective or do not correspond to the order placed by the User.
In the event of problems with the packaging, you must inform the carrier upon receipt of the order, indicating this on the receipt note or on the delivery person's electronic tablet.
• Refund
Regardless of the payment method you use, the refund will be processed as soon as possible, but always within 14 days of receiving the product in our warehouses. If payment was made by bank transfer, to process the refund, you must include an account number on the return form where the payment can be made.
• Out of Stock
If all units of the purchased product are out of stock, Customer Service will notify you of this fact as soon as possible through the contact methods provided during the purchase process. In this situation, PROCOMOBEL undertakes to refund the purchase amount immediately and, in any case, without undue delay.
Notwithstanding the foregoing, PROCOMOBEL has the right to offer merchandise with similar characteristics or of higher quality as an alternative. However, if you do not agree with this solution, you have a period of 14 days to withdraw from the purchase, in accordance with the provisions of the previous sections.
MINORS
PROCOMOBEL directs its services exclusively to users over 18 years of age. Minors under this age are NOT authorized to use our services and should therefore not send us their personal data. PROCOMOBEL assumes no liability should minors attempt to access or use the service in an unauthorized manner. For appropriate purposes, parents or legal guardians are urged to supervise the online activities of minors and ensure that they do not use this service without proper authorization.
DISPUTE RESOLUTION
Applicable Law and Jurisdiction
The relationship between PROCOMOBEL and the Consumer and User shall be governed by current Spanish law. In accordance with the provisions of Article 90.2 of the TRLGDCU (True General Law on Arbitration and Commercial Law), all disputes and claims arising from this legal notice shall be resolved by the Courts and Tribunals of the consumer's domicile.

• A detailed description of the intellectual property work you believe has been infringed.
• A clear and specific identification of the exact location on our website where the allegedly infringing content is located.
• Adequate contact information.
• A statement that you have a good faith belief that the use of the content in question is not authorized by the intellectual property rights owner, its legal representative, or the law.

What are discount coupons?
Discount coupons are promotional offers that allow a partial or total reduction in the price of the order or product. Coupons only apply to the products themselves and not to shipping costs.
